GENERAL TERMS AND CONDITIONS


1. AGREEMENT OVERVIEW
1.1. By booking services with Colourful Twist Entertainment ("we," "us," "our"), you ("Client") agree to these General Terms and Conditions ("T&Cs").
1.2. These T&Cs apply to all services provided and are accepted when you confirm your booking.
1.3. Any changes to these T&Cs must be agreed upon in writing.
1.4. The Agreement takes effect on the date you accept these T&Cs by checking the agreement box at the time of booking.


2. SERVICES AND PAYMENTS
2.1. The details of the services, including event dates and locations, will be outlined in your booking confirmation.
2.2. A 50% non-refundable deposit is required at the time of booking to secure the service. The remaining balance must be paid no less than 4 days before the event.
2.3. Payments must be made via electronic funds transfer or credit card.
2.4. Failure to pay within the agreed timeframe may result in cancellation, and interest may be applied to overdue amounts.
2.5. Rescheduling a booking incurs an additional 20% fee.
2.6. Cash Jobs: No deposit is required for cash bookings. Instead, agreeing to these terms and conditions an email confirmation will secure your entertainer. Payment must be made in full on the event day in cash unless otherwise agreed in writing.


3. SERVICE DELIVERY AND CLIENT RESPONSIBILITIES
3.1. We will provide services professionally and to the best of our ability.
3.2. You must provide accurate event details, including location, accessibility, and expected attendance.
3.3. We are not responsible for issues arising from incorrect information or venue restrictions.
3.4. We use high-quality, FDA-approved face paints and materials; however, we are not responsible for allergic reactions or injuries caused by product use.
3.5. Parents and caregivers are responsible for the supervision and safety of children at all times.
3.6. If unsafe or unruly conditions arise, we reserve the right to withdraw services without refund.


4. CANCELLATION AND REFUND POLICY
4.1. If you cancel:

  • 21+ days before the event: Full refund minus a $50 administration fee.

  • 10-20 days before the event: 50% refund minus a $50 administration fee.

  • 6-9 days before the event: 25% refund minus a $50 administration fee.

  • Within 5 days: No refund.

4.2. Cash jobs. If agreed to pay in cash on the day, understand that the same cancellation policy stated in term 4.1 will apply
4.3.If we cancel due to unforeseen circumstances, we will provide a full refund or reschedule where possible.

 

5. INTELLECTUAL PROPERTY AND MEDIA
5.1. We retain ownership of all content and images produced during the event.
5.2. You grant us permission to use images from the event for promotional purposes unless you explicitly request otherwise in writing.
6. LIABILITY AND INDEMNITY
6.1. We are not liable for injuries, damages, or losses incurred during service provision.
6.2. You agree to indemnify us against claims arising from your event.
6.3. We are not responsible for disruptions caused by force majeure events (e.g., extreme weather, natural disasters, pandemics).


7. OTHER TERMS
7.1. Travel fees ($30 - $120) apply for events over 30km from our location.
7.2. Parking fees apply if paid or metered parking is required at or near the venue.
7.3. Our entertainers have valid Working with Children Checks and public liability, available upon request.
7.4. Disputes must first be addressed directly with us. If unresolved, mediation will be required in our operating state.
7.5. By booking our services, you agree not to publicly disparage Colourful Twist Entertainment.
7.6. These T&Cs constitute the entire agreement between you and us and are governed by the laws of Victoria, Australia.


ACCEPTANCE
By booking our services and checking the agreement box, you confirm that you have read, understood, and agree to these T&Cs.
